§ 1 Definitions

  • Buyer: Every entity buying in the Store.
  • Consumer: Consumer within the meaning of the provisions of the Civil Code.
  • Privileged Buyer: Privileged Consumer or Entrepreneur (applies to contracts concluded from January 1, 2023).
  • Seller: PRIME TREND SP. Z OO, NIP 7312080478, REGON No. 524732447, Ul. Warszawska 62, Pabianice 95-200
  • Service Recipient (Newsletter): Entity using the Newsletter Service.
  • Service Provider (Newsletter): PRIME TREND SP. Z OO (same address as Seller)
  • Store: PAPAGAI Online Store Run By The Seller At WWW.PAPAGAI.EU
  • Working Days: Days from Monday to Friday, except public holidays.

§ 2 Contact With The Seller

§ 3 Technical Requirements

To properly function, the Store requires:

  • Device with internet access
  • Internet browser supporting JavaScript and cookies
  • Active e-mail account

§ 4 Shopping In The Store

  • You can browse products and add them to your cart.
  • You can register an account or checkout as a guest.
  • You can choose a delivery method and payment method.
  • Placing an order constitutes a sales agreement between you and the Seller.

§ 5 Payments

Available payment methods include:

  • Visa
  • Visa Electron
  • MasterCard
  • Maestro
  • Mastercard Electronic
  • Paynow
  • Bank Transfer (payment processed after credited to Seller’s bank account)

The total price of the order consists of the prices indicated in the Store for the goods and, if applicable, the costs of delivery.

§ 6 Order Execution

  • The order completion date is indicated in the Store.
  • In case of pre-payment, the Seller will process the order after the payment is received.
  • The Seller informs that some payment methods require immediate payment upon placing the order.
  • Goods are delivered only to the territory of Poland and the European Union (other than the carrier and designated by the Buyer).
  • Delivery methods include:
    • InPost Parcel Lockers
    • Via a Courier Company

§ 7 Right To Withdraw From The Contract (Right of Return)

The privileged buyer has the right to withdraw from the contract concluded with the Seller through the Store within 14 days without giving any reason.

  • The deadline for withdrawal expires after 14 days from:
    • In which the privileged buyer came into possession of the goods (for single good)
    • In which the privileged buyer came into possession of the last of the goods (for multiple goods)
    • In which a third party other than the carrier and designated by the privileged buyer takes possession of the last item (for contracts requiring transfer of ownership of multiple separately delivered goods)
  • To meet the withdrawal period, it is enough for the privileged buyer to send information regarding the exercise of the right to withdraw from the contract before the deadline expires.
  • The privileged buyer may use the sample withdrawal form provided at the end of the Regulations, but this is not obligatory.

§ 8 Exceptions To The Right To Withdraw From The Contract

The right of withdrawal does not apply to:

  • Goods that are made to the buyer’s specifications or are clearly personalized.
  • Goods that can deteriorate quickly or are short-lived.
  • Sealed goods which were opened after delivery and are not suitable for return due to hygiene reasons.
  • Goods which are, after delivery, due to their character, become inextricably connected with other things.
  • Recordings, such as sound or visual recordings or computer programs, delivered in a sealed package, where the package was opened after delivery.
  • For the delivery of newspapers, periodicals or magazines, with the exception of a subscription agreement.
  • The provision of services for which the price or remuneration depends on fluctuations in the financial market over which the Seller has no control and which may occur before
